Welcome to the Evergreen Medical Products website. These Terms of Use ("Terms") explain the rules for using this website. Please read them — they're short.

1. Acceptance of These Terms

By accessing or using evergreenmedicalproducts.com (the "Site"), you agree to these Terms. If you do not agree, please do not use the Site. These Terms apply to all visitors, including healthcare professionals, facility staff, and dealer partners.

2. Who This Site Is For

Evergreen Medical Products Ltd. ("Evergreen," "we," "us") is an independently owned Canadian distributor of medical devices, based in British Columbia. This Site is intended for:

  • Healthcare professionals, including occupational therapists and directors of care;
  • Long-term care facilities and their staff; and
  • Home medical equipment (HME) dealers across Canada — including dealers interested in carrying our products.

The Site is informational. It does not sell products or process payments. Its purpose is to help you learn about our products, request quotes and demonstrations, and access clinical education resources. Purchases are not made through this Site — they are arranged through our authorized dealer network or directly with Evergreen, under Evergreen's pricelist Terms & Conditions and, where applicable, dealer agreements.

If you are an individual, family member, or caregiver, the information on this Site is not a substitute for advice from a healthcare professional — please speak with a qualified clinician about which products may be appropriate for your situation.

3. No Medical Advice

Content on this Site — including product guides, specifications, cleaning instructions, clinical education materials, and downloadable resources — is provided for general informational purposes only. It is not medical advice, and it is not a substitute for professional clinical judgment.

Our products are medical devices regulated by Health Canada and are intended to be selected and used under the guidance of a qualified healthcare professional and in accordance with the applicable instructions for use. Decisions about whether a product is appropriate for an individual client or resident require assessment by a qualified clinician who knows that person's needs.

Nothing on this Site — including webinars, presentations, and other materials prepared or delivered by clinical educators — creates a clinician–patient relationship, constitutes clinical advice for any individual, or replaces a professional assessment. Clinical education content may be presented by independent healthcare professionals; their views and clinical opinions are their own and do not constitute product claims by Evergreen. Healthcare professionals remain responsible for exercising their own professional judgment and for confirming that information on this Site is current and appropriate before relying on it in clinical decision-making.

4. Intellectual Property

All content on this Site — text, images, product documentation, guides, logos, and design — is owned by Evergreen or its licensors and is protected by Canadian and international copyright and trademark law.

You may view, download, and print Site content for your own personal or professional reference — for example, to evaluate products for your facility or clients.

Letters of Justification — permitted adaptation. Our downloadable Letters of Justification are templates, and we want clinicians to use them. If you are a healthcare professional, you may adapt, complete, and submit these templates in support of funding applications for your clients — that is why we publish them. The templates are a starting point only: any letter you submit must reflect your own assessment of the individual client and your independent professional judgment, and you are responsible for the accuracy and appropriateness of its contents. Adaptations must not alter product specifications or attribute new product claims to Evergreen. Evergreen does not review or endorse individual funding submissions and makes no representation about funding outcomes. All other rights in the templates remain with Evergreen.

Apart from the uses described above, you may not reproduce, republish, or distribute Site content without our written permission.

5. Permitted and Prohibited Uses

You may use the Site for its intended purposes: learning about our products, submitting inquiries, and accessing resources. You may not:

  • Scrape, harvest, or bulk-download Site content or data by automated means;
  • Misrepresent your identity, credentials, or affiliation when submitting a form;
  • Republish Site content for commercial purposes or present it as your own;
  • Use the Site in any way that violates applicable law or interferes with its operation; or
  • Attempt to gain unauthorized access to any part of the Site or its systems.

6. Dealer Pricing Is Confidential

Any dealer pricing made available through this Site is confidential business information of Evergreen and is provided for use within your organization only. By accessing it, you agree to keep it within your organization and not to share, redistribute, or disclose it. Where applicable, your dealer agreement may impose additional obligations. If you have reached a pricing page in error, please close it and let us know.

7. Accuracy of Information

We work to keep Site content accurate and current, and we correct errors when we find them. However, product specifications, availability, and documentation may change without notice, and the Site may occasionally contain typographical errors or outdated information. Clinical education materials reflect the evidence and practice standards available at the time they were prepared. Product details, specifications, and pricing are confirmed at the time of order through your dealer or Evergreen directly — the Site is not an offer to sell.

8. Relationship to Other Terms

These Terms govern your use of the Site only. The purchase and sale of Evergreen products — including pricing, warranty, shipping, and returns — is governed by Evergreen's pricelist Terms & Conditions, the Warranty & Parts Guarantee, and, for dealers, the applicable dealer agreement. If these Terms conflict with those documents on any matter relating to a purchase or dealer relationship, the pricelist Terms & Conditions and dealer agreements prevail.

Your use of our inquiry forms and newsletter is also subject to our Privacy Policy, which explains how we handle personal information. The newsletter is monthly, and you can unsubscribe at any time.

9. Third-Party Links

The Site may link to third-party websites — for example, dealer sites, clinical resources, or regulatory bodies. These links are provided for convenience. We do not control third-party sites and are not responsible for their content, accuracy, or privacy practices. Linking does not imply endorsement.

10. Disclaimers and Limits of Liability

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. That includes warranties of accuracy, completeness, fitness for a particular purpose, and uninterrupted availability. This section applies to the Site only — it does not limit any product warranty set out in our pricelist Terms & Conditions, the Warranty & Parts Guarantee, or dealer agreements, and it does not exclude rights or remedies that cannot be excluded under applicable law, including the laws of British Columbia.

To the maximum extent permitted by law, Evergreen and its directors, officers, employees, and representatives will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site or its content. Where liability cannot be excluded, Evergreen's total liability relating to Site use is limited to $100 CAD.

11. Indemnity

If a breach of these Terms — for example, Section 5, or unauthorized disclosure of dealer pricing under Section 6 — causes a third-party claim against Evergreen, you agree to compensate Evergreen for losses reasonably arising from that claim.

12. Governing Law

These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there. Any dispute relating to these Terms or the Site will be resolved in the courts of British Columbia.

13. Changes to These Terms

We may update these Terms from time to time — for example, when we add Site features or when the law changes. The current version, with its "Last updated" date, is always posted here; for significant changes we'll flag the update. Continued use of the Site after an update means you accept the revised Terms as they apply to Site use. Changes to how we collect, use, or disclose personal information, or to email marketing consent, are governed by our Privacy Policy and applicable law and will not be made through these Terms alone.
